Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CampusMarket ("Company," "we," "us," or "our") governing your use of the CampusMarket platform, website, mobile application, and all related services (collectively, the "Platform").
1. The Platform and Our Role
CampusMarket is a passive online venue that provides technology infrastructure allowing college students to list, discover, and arrange the exchange of second-hand goods. CampusMarket is NOT a party to any transaction between users. We do not buy, sell, inspect, store, ship, or take physical or legal possession of any item listed on the Platform at any time.
We are a technology platform, not a store, retailer, auctioneer, broker, or financial institution.
CampusMarket operates as an interactive computer service as defined under 47 U.S.C. § 230 (the Communications Decency Act).
2. Eligibility and Account Requirements
2.1 Age Requirements: You must be at least 18 years of age to use the Platform. Users between 13 and 17 years of age may only use the Platform with verified parental or legal guardian consent.
2.2 Student Affiliation: CampusMarket is designed for current or recent students, faculty, and staff of accredited colleges and universities. We require .edu email verification to establish student status.
2.3 Account Security: You are solely responsible for all activity under your account. Notify us immediately at security@campusmarket.co if you suspect unauthorized access.
2.4 Accessibility: CampusMarket is committed to making the Platform accessible to users with disabilities in accordance with ADA Title III and WCAG 2.1 AA.
3. Listings — Seller Obligations and Liability
3.1 Accuracy Requirements: Every listing must be completely accurate. You may NOT post photos of items you do not own, misrepresent condition, list sold items, create duplicate listings, or use stock photos.
3.2 Content Moderation: CampusMarket employs automated keyword screening and manual review to detect prohibited listings.
3.3 Prohibited Items: Strictly prohibited items include illegal drugs, weapons of any kind, stolen property, counterfeit goods, alcohol or tobacco, prescription medications, recalled consumer products, adult content, live animals, and hazardous materials.
4. Buyer Responsibilities
CampusMarket is not responsible for recovering funds from failed off-platform transactions. Always meet in public Safe Exchange Zones, never alone at night for transactions over $50, never at your home, and always inform someone of your whereabouts.
5. Payments, Taxes, and Financial Obligations
5.1 Payment Processing: CampusMarket may facilitate payments through Stripe, Inc. or other third-party processors.
5.2 Sales Tax: Certain U.S. states have enacted Marketplace Facilitator laws that may require CampusMarket to collect and remit sales tax on qualifying transactions.
5.3 No Money Transmission: CampusMarket does not hold, transmit, or escrow user funds.
6. Privacy, Data, and International Users
Your use of the Platform is governed by our Privacy Policy, incorporated here by reference. We honor the rights provided under all applicable laws including CCPA, GDPR, and UK GDPR.
7. Harassment and User Misconduct
Immediate permanent termination applies to: threatening, harassing, stalking, or intimidating any user; using the Platform to arrange harm to any person; doxxing; discrimination based on any protected characteristic. Report to safety@campusmarket.co.
8. Intellectual Property
You retain copyright in photos you take of your own items and grant CampusMarket a license to display them. Posting third-party photos is copyright infringement. Report to dmca@campusmarket.co.
9. Platform Availability
CampusMarket does not guarantee uninterrupted service. Maintain your own records of all listings and communications.
10. Termination
CampusMarket may terminate or suspend your account immediately without notice for any violation of these Terms.
11. Dispute Resolution
11.1 Informal Resolution: Before initiating any formal legal process, contact legal@campusmarket.co and attempt good-faith resolution for at least 30 days.
11.2 Binding Arbitration: If informal resolution fails, all disputes shall be resolved by binding individual arbitration administered by the AAA.
11.3 Class Action Waiver: You waive any right to bring or participate in a class action against CampusMarket.
12. Limitation of Liability
CampusMarket's total liability for any claim shall not exceed the greater of (a) total fees paid by you in the six months preceding the claim, or (b) fifty dollars ($50.00).
13. Indemnification
You agree to defend, indemnify, and hold harmless CampusMarket from any claims arising from your use of the Platform or any item you list or sell.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated at least 14 days before taking effect.
